Contestant Eligibility- CheapOair and Woman’s World Drawing
Eligibility: No purchase is necessary to enter contest and/or claim prize. The CheapOair Travel Giveaway (the “Contest”) is open to anyone who is a legal residents of the 50 United States (including the District of Columbia but excluding Puerto Rico and all other U.S. and foreign territories and possessions), reside and be physically present and reside in the U.S. as of the date of entry through and including the date of awarding of prizes, and be eighteen (18) years or older as of the date of entry. Employees of CheapOair (“Sponsor”) and their respective affiliates, subsidiaries, judging and other coordinating agencies involved in the promotion and the immediate families of each are not eligible to enter. The Contest is subject to all applicable federal, state, and local laws and void where prohibited by law. By entering, you agree to the Official Rules and the decisions of CheapOair, which will be final and binding. To be eligible for the giveaway, electronic entries must be received by 11:59 p.m. Eastern Daylight Savings Time (“EDT”) on the last day of the contest.
How to Enter: Electronically submit name, address, and contact information on the respective CheapOair web page at www.cheapoair.com/ww during the contest period.
Contest Period: The Contest begins at 09:00 a.m. EDT on July 7, 2009 and ends at 11:59 p.m. EDT on August 22, 2009 (the “Contest Period”). In the event of a dispute about the identity of an entrant, the entrant will be the registered and identified by the submitted e-mail address.
Selection of Winners: At the end of the Contest Period entrants will be selected by the Sponsor from the eligible pool of entries through a random drawing. The odds of winning depend upon the number of entries received. There is no limit as to how many times a participant may enter. However, a participant may win only once, regardless of the numbers of entries.
Notification: The drawing of the winners by the Sponsor will be final and binding on all matters relating to the Contest. All winners will be required to sign and return to Sponsor an Affidavit of Eligibility, a Liability and a Publicity Release within fourteen (14) days of the date of the winning notification. Unclaimed prizes are subject to forfeiture, and a new winner will be selected through an additional random drawing.
Prizes: The winners will each receive one (1) CheapOair Gift Card with a total value of US$500.00 (five-hundred US Dollars) for redemption toward airline tickets purchased on www.CheapOair.com. The CheapOair Gift Cards have no cash value and can only be redeemed towards a purchase of airline tickets online on www.CheapOair.com. Booking airline tickets on www.CheapOair.com are subject to availability. CheapOair Gift Cards must be redeemed within three (3) months of the date of its issuance, and actual travel must be completed within six (6) months of booking airline ticket(s). Expired Gift Cards will not be extended and will not be honored by CheapOair after the date of expiration. CheapOair’s Gift Card restrictions, as described herein, shall be subject to all applicable Federal, State, and Local Taxes which compliance thereof shall be the sole responsibility of each Prize Winner. Prizes (Gift Card) are non-transferable, non-redeemable for cash and will not be replaced, extended and/or substituted whatsoever. If less than five-hundred (500) entries to the Contest are received, than the Prize will be a US$50 (fifty US Dollars) American Express Gift Card, in lieu of the US$500.00 (five-hundred Dollars) CheapOair Gift Card.
Release of Liability: By accepting the prize, the winner agrees to release CheapOair and its agencies from any and all liability for injuries and/or damages of any kind, in whole or in part, sustained in connection with the award of the prize. No prize substitutions are granted except as otherwise provided herein. By accepting the prize, the winner consents to the use of his/her name, photo and/or likeness for advertising and promotional purposes without additional compensation, except where prohibited by law.

Additional Rules: Contestant entrants will be automatically subscribed to the CheapOair newsletter which contestants may unsubscribe at any time. A subscription is not required to win. Contest entrant agrees to hold harmless Sponsor, its officers, directors, employees, divisions, affiliates, subsidiaries, advertising and promotional agencies, from any and all claims by any third party relating to any rights. By participating in the Contest, entrant agrees to be bound by these Official Rules, including all eligibility requirements and all decisions of Sponsor, which are final and binding in all matters relating to the Contest. Sponsor is not responsible for: (i) lost, late, misdirected, damaged, garbled or illegible entries/registrations; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry/registration materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Contest. Furthermore, Sponsor reserves the right to: (iv) permanently disqualify from any contest it sponsors any person it believes has intentionally violated these official rules; and (v) suspend, modify or terminate the Contest if Sponsor believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity of the Contest. If the Contest is terminated before the end date, Sponsor will determine the winner from all eligible entries received as of the termination date. Sponsor reserves the right to disqualify any unauthorized entries, including, without limitation, multiple entries from the same person. Entering the Contest constitutes permission to use the name, voice, photo, and likeness of the winner for advertising and publicity purposes, without further compensation.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

PRIZE ACCEPTANCE FORM
Upon completion of the random drawing, CheapOair will send the winners a Prize Notification along with a Prize Acceptance Form, a written Affidavit and Release Form to be completed to the e-mail address provided by the winner at the time of entering the contest. A signed copy of (i) the Prize Acceptance From, (ii) signed written Affidavit and (iii) signed Release From must be mailed to CheapOair at 213 West 35th Street, 13th Floor, New York, New York 10001. Upon receipt of the signed Prize Acceptance Form, the Affidavit and Release Form, CheapOair will send the CheapOair Gift Card of a maximum value of US$ 500.00 (five-hundred US Dollars) to the winner at the address provided by the winner.
I, the undersigned winner, understand and agree:
1.that I must, in order to make use of my Prize, redeemed my CheapOair Gift Card within three (3) months of the date of its issuance on www.CheapOair.com.
2.that failure to redeem my CheapOair Gift Card within the time period as described herein will result in the undisputed forfeiture of my Prize
3.that actual travel must be completed within six (6) months of booking the airline ticket(s) on www.CheapOair.com
4.that all airline ticket(s) purchase on www.CheapOair.com are subject to seat availability
5.that some airline tickets may require advanced purchase (up to twenty-one [21] days prior to departure) in order to obtain desired availability
6.that travel during weekdays such as on Tuesday’s, Wednesday’s and Saturday’s may have a higher chance for availability
7.that CheapOair does not guarantee any airlines seat availability and that all bookings made on www.cheapoair.com are subject to the term and conditions posted on www.CheapOair.com
8.that, in order to make use of my CheapOair Gift Card, I will book and purchase online at www.cheapoair.com one (1) or more airline ticket(s) using a valid credit card of mine and pay the full amount for such airline ticket(s) purchase to be charged to my credit card at the time of booking
9.that, upon completion of my airline ticket(s) purchase, I will mail the original CheapOair Gift Card to CheapOair at 213 West 35ht Street, 13th Floor, New York New York 10001 by either overnight courier or certified mail, along with the receipt of the airline ticket purchase on www.cheapoair.com
10.that only the original CheapOair Gift Card will be honored and copies thereof will be considered as null and void
11.that upon receipt of the original CheapOair Gift Card, CheapOair will refund up to $500.00 (five-hundred Dollars) to my credit card on the day of receipt of the original Gift Card
12.that the refund as stated herein may take four (4) to six (6) weeks to appear on my credit card statement
13.that the CheapOair Gift Certificate can be used only one once
14.that in the event that the value of the airline ticket(s) purchased is/are less than $500.00 (five-hundred US Dollars) the remaining balance will not be refunded and/or credited in any form or shape whatsoever
15.that the Gift Card after its day of expiration will not be subject to extension and will not honored by CheapOair whatsoever
16.that the CheapOair Gift Card is non-transferable, will not be substituted, if lost will not be replaced, its validity will not be extended and is non-redeemable for cash whatsoever
17.that the CheapOair Gift Card cannot be resold or bartered, and has no cash value if it is not used
18.that I voluntarily will provide CheapOair with an image of mine as the winner (.jpeg, .bmp) which may or may not be used for and in future publicity or other campaigns
19.that I waive any and all rights and rights for claims for any kind of compensation and/or award from CheapOair for the use of my name and/or my image as the winner of the contest for eventual future publicity and other campaigns and for any other reasons whatsoever
20.that CheapOair will not be responsible for any losses and/or consequential damages in whole or in part arising out of non-availability of desired flights I have selected and CheapOair will not make any remedies available under any circumstances in the event that I am unable to book the flights of my choice(s) for any reasons whatsoever
